By downloading, installing, or using the Fitly mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Fitly is a fitness tracking and workout planning application that helps users:

Track workouts and exercise routines
Monitor fitness progress and body measurements
Plan and schedule workout sessions
Access exercise libraries and instructional content
Set and track fitness goals

3. User Accounts

Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5. Health and Safety Disclaimer

Important Health Notice

Fitly is not a medical device or health care provider. The App is intended for general fitness tracking and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult with a qualified healthcare provider before starting any exercise program or making significant changes to your fitness routine, especially if you have pre-existing health conditions.

6. User Content

You retain ownership of content you create or upload to the App. However, by using the App, you grant us a limited license to use your content to provide and improve our services.

We may remove content that violates these Terms or our community guidelines without notice.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Subscription and Payments

Some features of the App may require a paid subscription. Subscription fees are charged in advance and are non-refundable except as required by law.

You may cancel your subscription at any time through your account settings or the app store through which you purchased the subscription.

9. Intellectual Property

The App and its original content, features, and functionality are owned by Fitly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, Fitly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

11. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
